Bor4D is responsible for the processing of all data collected from interested parties for the exercise of its business functions, which are developed in accordance with the criteria and limitations established by Regulation (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR) and by Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

2. Purpose

The personal data that you provide to Bor4D will be incorporated into a data file owned by Bor4D and maintained under its responsibility.

The purpose of this file is to manage Bor4D's relationship with its customers, suppliers and collaborators, to provide them with the information they request, and to manage the services that are contracted.

In addition, it will serve to keep you informed about Bor4D services, using the email address or other contact information provided by the user with their express consent.

The information you provide is voluntary. However, if you do not provide it, we will not be able to provide you with the service.

It will be your obligation to keep the data updated so that it corresponds to reality at all times.

Any false or inaccurate statement that occurs as a result of the data provided, as well as the damages that such information may cause to Bor4D, will be the responsibility of the user.

3. Legal Basis for Processing

• Contractual relationship: This applies when you contract any of our services.
• Legitimate interest: To respond to queries and complaints that you raise and to manage the collection of amounts owed.
• Your consent: If you are a user of our website, by marking the box on the contact form, you authorize us to send you the communications necessary to respond to the query or request for information raised.

4. Data Retention Periods

We will only keep your personal data for as long as is necessary to achieve the purposes for which it was collected. When determining the appropriate retention period, we examine the risks involved in the processing, as well as our contractual, legal and regulatory obligations, internal data retention policies and our legitimate business interests described in the "Purpose" section.

In this sense, Bor4D will keep personal data once its relationship with you has ended, duly blocked, during the limitation period for actions that may arise from the relationship maintained with the interested party.

Once blocked, your data will be inaccessible and will not be processed except for making it available to public administrations, Judges and Courts, to address possible liabilities arising from the treatments, as well as for the exercise and defense of claims before the Spanish Data Protection Agency.

Bor4D will only allow access to personal data to those collaborators or dependents who need to access personal data by reason of the activity they develop within the framework of the contracted services.

To guarantee compliance with the provisions of the General Data Protection Regulation, when Bor4D entrusts processing activities to a processor, it will only use processors that offer sufficient guarantees, particularly with regard to specialized knowledge, reliability and resources, in order to the application of technical and organizational measures that meet the requirements of the GDPR, including the security of the processing.

6. International Data Transfers

We inform you that Bor4D does not carry out transfers of personal data to third countries or to international organizations.

7. Rights

We inform you that you may exercise the following rights:

• Right of access to your personal data, to know what is being processed and the processing operations carried out with them.
• Right to rectify any inaccurate personal data.
• Right to delete your personal data, when this is possible (for example, by legal imperative).
• Right to limit the processing of your personal data when the accuracy, legality or necessity of the processing of the data is doubtful, in which case, we may keep them for the exercise or defense of claims.
• Right to object to the processing of your personal data, when the legal basis that enables us to process it is our legitimate interest. Bor4D will stop processing your data unless it has a legitimate interest or is necessary for the defense of claims.
• Right to the portability of your data, when the legal basis that enables us to process it is the existence of a contractual relationship or your consent.
• Right to revoke the consent granted to Bor4D.

To exercise your rights, you can do so for free and at any time by writing to us at comunica@bor4d.com, signing the application document with your digital certificate or requesting and filling out the corresponding right form.

8. Complaint before the Supervisory Authority

If you believe there is a problem with the way Bor4D is processing your data, you can address your complaints to the corresponding data protection authority, being the Spanish Data Protection Agency the indicated in the case of Spain. The Agency's email address is www.agpd.es

9. Modification of the Privacy Policy

Bor4D may modify this Privacy Policy at any time.

In any case, Bor4D will communicate with prior notice the modifications of this policy that affect users so that they can accept them.
